You may have noticed by now that I have a thing for Daniel Kahneman.
Kahneman was the psychologist who won the Nobel Prize in Economics for showing that human judgment is rather less rational than lawyers once hoped.
There is one experiment of his I particularly like.
Kahneman and David Schkade compared students living in California with students in the American Midwest.
California had sunshine.
The Midwest had winter.
Sometimes several winters at once.
So when people were asked who must be happier, they expected the Californians to win easily.
They did not.
Reported life satisfaction was remarkably similar.
The weather was different.
Monday morning was still Monday morning.
The mistake was simple.
When people compared both places, they focused on the most obvious difference:
Climate.
And whatever we focus on starts pretending to be the whole picture.
Kahneman called this the focusing illusion.
One argument with your partner about the dishwasher and, for ten minutes, the dishwasher becomes the marriage.
Legal knows the feeling.
At 9:04 a.m., the CEO forwards a regulator’s letter:
“Need this today.”
By 9:17, the matter has swallowed your disputes lawyer, your privacy lead, your best commercial counsel and lunch.
It may be serious.
But attention is not materiality.
Urgency is not a complete risk assessment.
